She has done it once again. Kim K gets awarded $2.7 million in damages along with $60,000 in attorney fees against Missguided USA for knocking off her dresses.According to TMZ, Page Six, and other news outlets, Kim K filed a lawsuit against Missguided USA for using her name and likeness to sell lower-priced copies of her dresses.  The judge ruled that “Missguided has repeatedly used Kardashian’s name and likeness without permission on its social media platforms to promote the sale of its clothing.” Kim originally wanted damages in excess of $10 million but since Missguided allegedly did not respond to the lawsuit, Kim won by default. Missguided USA is now barred from using any Kim Kardashian trademarks.

Generally, in trademark infringement cases civil remedies are awarded, however, if Missguided still continues to use Kim K’s trademarks even after it has been barred from doing so, she can file for criminal penalties against the clothing company. The criminal penalties can result in prison time or an even bigger monetary reward for Kim. Considering the company has not responded to the first suit against them, there is a chance they might do it again.
