LEGAL WAR: Nick Loeb Loses Appeal in Sofia Vergara Embryo Saga

LEGAL WAR. Nick Loeb’s legal case with Sofia Vergara over her frozen embryos has ended in Louisiana. The Appeals court ruled that the case should be tossed out and it has made a mockery of the Louisiana legal system.

Vergara and Loeb battled over the couples two frozen embryos from their 2013 IVF treatments. Loeb sought custody of the embryos to bring them to term. The case originally began in California where the embryos are frozen. Loeb transferred the case to Louisiana hoping the state would recognize their legal rights. Loeb claimed he is domiciled in the state, the court found that Loeb is not domiciled and nor does he reside in the state and he has been forum shopping.

A case can be dismissed for improper venue. Courts are designated according to a city, county, or judicial district. Venue rules exist to prevent a defendant from litigating a case in an excessively inconvenient forum. Such as Loeb has by filling the case in Louisiana.
