{"id":668,"date":"2018-08-15T16:04:19","date_gmt":"2018-08-15T21:04:19","guid":{"rendered":"http:\/\/askcarterlaw.com\/?p=668"},"modified":"2018-08-15T16:06:35","modified_gmt":"2018-08-15T21:06:35","slug":"will-trumps-nda-shutdown-omarosa","status":"publish","type":"post","link":"https:\/\/askcarterlaw.com\/home\/will-trumps-nda-shutdown-omarosa\/","title":{"rendered":"Will Trump\u2019s NDA shutdown Omarosa?"},"content":{"rendered":"<p>Former Apprentice Star and White House Employee Omarosa Manigault Newman has landed in the hot seat for not just exposing President Donald Trump\u2019s racist conduct (in particular his use of \u201cN\u201d word) but also because she illegally taped him in the West Wing breaching all sorts of security rules. It doesn\u2019t appear the government will be prosecuting Omarosa for this breach (yet), however it does raise a question regarding whether Trump can stop Omarosa\u2019s tirade with his NDA he made her and allegedly all of his White Employees sign.<\/p>\n<p>According to a draft obtained by the Washigton Post:<\/p>\n<p>It would expose violators to penalties of $10 million, payable to the federal government, for each and any unauthorized revelation of \u201cconfidential\u201d information, defined as \u201call nonpublic information I learn of or gain access to in the course of my official duties in the service of the United States Government on White House staff,\u201d including \u201ccommunications .\u2009.\u2009. with members of the press\u201d and \u201cwith employees of federal, state, and local governments.\u201d The $10 million figure, I suspect, was watered down in the final version, because the people to whom I have spoken do not remember that jaw-dropping sum.<\/p>\n<p data-elm-loc=\"13\">It would also prohibit revelation of this confidential information in any form \u2014 including, \u201cthe publication of works of fiction that contain any mention of the operations of the White House, federal agencies, foreign governments, or other entities interacting with the United States Government that is based on confidential information.\u201d<\/p>\n<p data-elm-loc=\"14\">Lastly, this restriction would cover Trump employees not only during their White House service but also \u201cat all times thereafter.\u201d<\/p>\n<p data-elm-loc=\"14\">The NDA is purposefuly broad and aggressive. But can it be enforced? Most likely no for three reasons:<\/p>\n<p data-elm-loc=\"14\">1) Freedom of Information Act Violation<\/p>\n<p data-elm-loc=\"14\">FOIA is a federal law which allows individuals to obtain access to certain records from federal agencies. It is very possible that a FOIA request could conflict with a non-disclosure agreement. A FOIA request might, for instance, cover a request for information on a government contract or grant or an unpublished policy statement, the substance of which is otherwise \u201cnonpublic.\u201d<\/p>\n<p data-elm-loc=\"14\">2) Whistle Blower Act Violation<\/p>\n<p>Federal Whistleblower laws protect government employees who report certain activities.
