Neither side has commented on the terms.<\/p>\n<p>Back in 2018, Netflix created an interactive experience, Black Mirror: <em>Bandersnatch<\/em>.\u00a0In <em>Bandersnatch<\/em>, a video game designer prepares to pitch something he wishes to create. This character explains to his father that the game is based on the work of a fictional book. The father says the author must be good because his son is always flicking backwards and forwards.\u201d The son responds, \u201cNo, it\u2019s a \u2018Choose Your Own Adventure\u2019 book.\u201d\u00a0 Later, when <em>Bandersnatch<\/em> was released, audiences noted the similarity to the book, \u2018Choose Your Own Adventure.\u201d<\/p>\n<p style=\"text-align: center\"><a href=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/11\/02LGJA5oo7LD0iKboos4Drn-1..1569489444.png\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone size-medium wp-image-3729\" src=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/11\/02LGJA5oo7LD0iKboos4Drn-1..1569489444-300x169.png\" alt=\"\" width=\"300\" height=\"169\" srcset=\"https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/11\/02LGJA5oo7LD0iKboos4Drn-1..1569489444-300x169.png 300w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/11\/02LGJA5oo7LD0iKboos4Drn-1..1569489444-768x432.png 768w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/11\/02LGJA5oo7LD0iKboos4Drn-1..1569489444.png 810w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Earlier this year, a judge denied Netflix\u2019s motion to dismiss the case.\u00a0 Netflix had put up a First Amendment defense, in which the judge found factual issues that needed to be explored in discovery. \u00a0Netflix then got aggressive with a bid to cancel the \u201cChoose Your Own Adventure\u201d trademark.<\/p>\n<p>Chooseco continues to maintain its mark. \u00a0Chooseco has also applied to have the mark officially classified in downloadable animated video recordings featuring multiple choice endings.<\/p>\n<p>Did you take part in <em>Bandersnatch<\/em>? \u00a0To make sure your trademark is protected like Chooseco&#8217;s, reach out to Carter Law Group.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A current entertainment industry lawsuit has been settled.
