{"id":3575,"date":"2020-10-30T13:44:31","date_gmt":"2020-10-30T18:44:31","guid":{"rendered":"http:\/\/askcarterlaw.com\/?p=3575"},"modified":"2020-10-30T15:04:03","modified_gmt":"2020-10-30T20:04:03","slug":"day-in-court-judge-denies-kardashians-motion-to-dismiss-lawsuit-brought-by-blac-chyna","status":"publish","type":"post","link":"https:\/\/askcarterlaw.com\/home\/day-in-court-judge-denies-kardashians-motion-to-dismiss-lawsuit-brought-by-blac-chyna\/","title":{"rendered":"DAY IN COURT: Judge denies Kardashians\u2019 motion to dismiss lawsuit brought by Blac Chyna"},"content":{"rendered":"<p>\u201cChyna is beyond thrilled that she will have her day in court.\u201d<\/p>\n<p>This week, Chyna won a small legal victory over the Kardashians as a judge refused to grant the Kardashians\u2019 motion to dismiss of Chyna&#8217;s lawsuit alleging the Kardashians were responsible for the cancellation of her E! reality show, \u201cRob and Chyna.\u201d Chyna\u2019s lawyer (Lynne Ciani) told <em>US Weekly<\/em> that Chyna is seeking \u201cmillions in compensatory and punitive damages from Kris, Kim, Khloe and Kylie for defamation, intentional interference with contract, and intentional interference with prospective economic advantage.\u201d<\/p>\n<p><a href=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-Chyna-Pregnant.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-3579 aligncenter\" src=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-Chyna-Pregnant-300x225.jpg\" alt=\"\" width=\"328\" height=\"246\" srcset=\"https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-Chyna-Pregnant-300x225.jpg 300w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-Chyna-Pregnant-768x576.jpg 768w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-Chyna-Pregnant-1024x768.jpg 1024w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-Chyna-Pregnant.jpg 1600w\" sizes=\"(max-width: 328px) 100vw, 328px\" \/><\/a><\/p>\n<p>The judge determined that Chyna provided \u201csubstantial evidence\u201d as to move forward with her claims. Evidence filed by Chyna included unaired footage of Season 2 of \u201cRob and Chyna\u201d as well as internal business documents from NBCUniversal and Bunim Murray productions, which corroborate the network\u2019s intention to renew the show for a second season. Black Chyna is adamant that the Kardashians\u2019 wielded their \u201cpower and influence over the E! network to kill the second season.\u201d She further alleges that NBCUniversal \u201ctrampled\u201d on her rights and is plagued by systemic racism, however, NBCUniversal (nor its subsidiary E!) are named as defendants to the lawsuit.<\/p>\n<p>Rob\u2019s attorney (Marty Singer) counters Chyna\u2019s claims by asserting that the series was cancelled, not because of the Kardashians\u2019 ill will, but because of the couple\u2019s split in December of 2016 after the airing of the first season of the show. E! told <em>Variety<\/em> in July 2017 that the series had been put \u201con hold\u201d and that they intended to \u201cfollow the family\u2019s lead\u201d on whether to continue with production.<\/p>\n<p><a href=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-and-Chyna.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-3578 aligncenter\" src=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-and-Chyna-225x300.jpg\" alt=\"\" width=\"280\" height=\"373\" srcset=\"https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-and-Chyna-225x300.jpg 225w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-and-Chyna-768x1024.jpg 768w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/Rob-and-Chyna.jpg 1080w\" sizes=\"(max-width: 280px) 100vw, 280px\" \/><\/a><\/p>\n<p>That the judge allowed Chyna\u2019s claims to continue to trial, indicates that there are legitimate questions of fact as to whether the Kardashians caused cognizable legal harm. Chyna claims that her reality TV career was \u201cpermanently damaged\u201d as a result of the Kardashians\u2019 actions. This demonstrates reputational injury and may entitle her to damages under her defamation claim if she can prove that the Kardashians acted with actual malice. It is unclear what the terms of contract were between E!, Black Chyna and the Kardashians regarding the show. If she is able to prove that a provision of her contract with them was breached, compensatory damages would entitle Chyna to reimbursement for any financial injury she sustained as a result of that breach. Punitive damages may be harder to obtain as Chyna would have to further establish that the Kardashians\u2019 conduct was egregious and that compensatory damages are inadequate as to punish their wrongdoing.<\/p>\n<p><a href=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\" wp-image-3582 aligncenter\" src=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream-300x200.jpg\" alt=\"\" width=\"332\" height=\"221\" srcset=\"https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream-300x200.jpg 300w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream-768x512.jpg 768w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream-1024x683.jpg 1024w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream-1600x1067.jpg 1600w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/10\/BC-Rob-Dream.jpg 2000w\" sizes=\"(max-width: 332px) 100vw, 332px\" \/><\/a><\/p>\n<p>Chyna and Rob continue to battle in court over custody and visitation of their 3-year-old daughter Dream and last month, a judge refused to drop previous assault charges filed by Rob against Chyna.<\/p>\n<p>Will Blac Chyna prevail over the Kardashian empire?
