On August 6th, President Donald Trump issued an executive order that would bar \u201cany transaction by any person\u201d with Tik Tok\u2019s parent company, ByteDance or any of its subsidiaries, due to data privacy concerns.<\/p>\n

According to the order, TikTok \u201ccaptures vast swaths of information from its users,\u201d which could allow the Chinese government \u201cto track the locations of Federal employees and contractors, build dossiers of personal information for blackmail, and conduct corporate espionage.\u201d Trump\u2019s order also said that TikTok \u201creportedly censors\u201d content and \u201cmay also be used for disinformation campaigns.\u201d<\/p>\n

A new issue is that a ban on TikTok may have First Amendment violation concerns.<\/p>\n

Electronic Frontier Foundation Civil Liberties Director David Greene says, \u201cIf the effect is to make it illegal for U.S persons to use TikTok, then serious First Amendment concerns will be raised.\u00a0 When people use TikTok they\u2019re speaking. It\u2019s also a serious First Amendment issue if it would make it illegal for the app stores to distribute TikTok. The app stores themselves have a First Amendment right to distribute speech and the apps themselves are speech.\u201d<\/p>\n

Microsoft and Twitter have both been heard to be interested in acquiring TikTok. If either of these companies do, the national security and data concerns may be reduced.<\/p>\n
