{"id":2317,"date":"2020-06-16T14:04:39","date_gmt":"2020-06-16T19:04:39","guid":{"rendered":"http:\/\/askcarterlaw.com\/?p=2317"},"modified":"2020-06-16T14:04:39","modified_gmt":"2020-06-16T19:04:39","slug":"unbelievable-man-files-for-trademark-to-use-george-floyds-name-in-hollywood-projects","status":"publish","type":"post","link":"https:\/\/askcarterlaw.com\/home\/unbelievable-man-files-for-trademark-to-use-george-floyds-name-in-hollywood-projects\/","title":{"rendered":"UNBELIEVABLE: Man Files for Trademark To Use George Floyd\u2019s Name in Hollywood Projects"},"content":{"rendered":"<p>Say his name.<\/p>\n<p>There is no doubt that the name\u00a0George Floyd\u00a0will live on well after protests have gone\u2014and some random person is trying to make a profit from that.<\/p>\n<div>According to legal documents revealed by TMZ, a Rhode Island man\u00a0named Munemo Mushonga\u00a0filed a trademark application on June 5 for the name \u201cGeorge Floyd\u201d to be used for \u201cproduction and distribution of television shows and movies.<\/div>\n<div><\/div>\n<div><a href=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1.jpeg\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-2319 aligncenter\" src=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1-300x200.jpeg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1-300x200.jpeg 300w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1-768x512.jpeg 768w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1-1024x683.jpeg 1024w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1-1600x1067.jpeg 1600w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/06\/image1.jpeg 1620w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/div>\n<div>\n<p>&nbsp;<\/p>\n<p>What is interesting about this filing is that Mushonga has no relation to Floyd and it doesn&#8217;t seem like he has any Hollywood connections either. In order for the trademark to be approved, Mushonga would need written consent from Floyd himself. Even a representative wouldn&#8217;t be enough. Legal grounds that would bar Mushonga from succeeding in a claim include the Trademark Act U.S.C section 1052(a) which prohibits something from being trademarked if it has a \u201cfalse suggestion of connection\u201d. In this case, Mushonga would clearly fail to overcome this hurdle given the fact that he is not related or connected to Floyd in any way.<\/p>\n<p>Fortunately, if Floyd&#8217;s family is not on board, then this trademark filing will most certainly be denied.<\/p>\n<p>UPDATE: As of 6\/12\/2020, the filer of the &#8220;George Floyd&#8221; trademark application has filed a voluntary notice of abandonment.<\/p>\n<p>Do you think Mushonga abandoned the application due to the backlash he was receiving online, or because he realized it&#8217;s pretty unethical to profit off of a dead man&#8217;s name who has no relation to him?
