Since there was no physical or forensic evidence the whole trial rested upon the credibility of the witnesses and victims. He was remanded into custody without bail against the protests of his attorneys who cited his \u201cmedical\u201d conditions.<\/p>\n<p>Weinstein has been convicted of criminal sexual assault in the first degree, based on the testimony of former Project Runway production assistant Miriam Haley, and rape in the third degree, based on the testimony of actress Jessica Mann.<\/p>\n<p><a href=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/02\/4D17D381-E563-4FE2-8BDB-A37ED84B81B6.jpeg\"><img decoding=\"async\" loading=\"lazy\" class=\"size-medium wp-image-1876 aligncenter\" src=\"http:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/02\/4D17D381-E563-4FE2-8BDB-A37ED84B81B6-300x200.jpeg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/02\/4D17D381-E563-4FE2-8BDB-A37ED84B81B6-300x200.jpeg 300w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/02\/4D17D381-E563-4FE2-8BDB-A37ED84B81B6-768x512.jpeg 768w, https:\/\/askcarterlaw.com\/wp-content\/uploads\/2020\/02\/4D17D381-E563-4FE2-8BDB-A37ED84B81B6.jpeg 915w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Here are the convictions explained:<\/p>\n<p><strong>Criminal sexual act in the first degree: <\/strong>In New York, the crime of a <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PEN\/130.50\" target=\"_top\">\u201ccriminal sexual act\u201d<\/a> refers to nonconsensual oral or anal sex. A person is guilty of a criminal sexual act in the first degree if they engage \u201cin oral sexual conduct or anal sexual conduct\u201d by \u201cforcible compulsion.\u201d Weinstein was charged with this count in connection with testimony by Miriam Haley.<\/p>\n<p>Haley testified that on a visit to his apartment in 2006, Weinstein pushed her with his body into a bedroom until she fell on the bed. \u201cI tried to get up, and he pushed me down repeatedly, by that time I started realizing what was happening \u2026 that this was rape,\u201d she testified, <a href=\"https:\/\/www.buzzfeednews.com\/article\/nishitajha\/harvey-weinstein-mimi-haley-rape-trial\" target=\"_top\">according to BuzzFeed<\/a>. Haley said that Weinstein ultimately performed oral sex on her without her consent.<\/p>\n<p><strong>Rape in the third degree:<\/strong> In New York, a person is <a href=\"https:\/\/www.nysenate.gov\/legislation\/laws\/PEN\/130.25\" target=\"_top\">guilty of this crime<\/a> if they engage \u201cin sexual intercourse with another person without such person\u2019s consent.\u201d This charge does not require prosecutors to prove \u201cforcible compulsion\u201d on the part of the defendant or that the victim was \u201cphysically helpless\u201d at the time.
