PROBATION VS INCARCERATION: Lori Harvey gets 2 years probation in hit and run case.

In January of 2020, model, Lori Harvey was involved in a hit and run accident. According to the L.A. County District Attorney’s Office, Steve Harvey’s daughter, Lori Harvey, was charged with one count of resisting/delaying/obstructing a peace officer, and one count of hit and run resulting in property damage. Both are misdemeanors. 

Harvey allegedly was at fault which probably explains why she tried to leave the scene of the accident. Witnesses informed the officers that Harvey smashed into another car while texting and driving. Cops found Harvey walking down the street a short distance from the accident. The model also Face Timed her dad, Steve Harvey, while dealing with officers. Although, Harvey’s car was flipped on its side, no one was seriously injured.

 


According to California law, it is a crime to flee the scene of an accident, without stopping and providing your information, when  the accident caused damage to other vehicles or property. Here, it appears that there was damaged to the vehicles, but no one was seriously injured. Harvey appears to have been involved trying to flee the scene by walking away without providing her information. Since no one was injured this is more than likely why it was ruled a misdemeanor hit and run and not a felony misdemeanor.

The distinction between misdemeanor and felony hit and run turns on whether or not someone was injured. When the accident only causes property damage, then the state can only file misdemeanor charges. But if the victim of the hit and run suffers bodily injury or death, then the person may be charged with felony hit and run. Misdemeanor hit and run is punishable by up to 6 months in jail, fines of up to $1,000.00, restitution to the victims for any property damage, and 2 points on the person’s California driving record. Here, Harvey was able to avoid jail time after entering a plea deal in her case. However, the model was not able to avoid all consequences. Harvey pled no contest to one misdemeanor count of resisting arrest. In exchange, she  was sentenced to 2 years of probation. Since Harvey is a model there may also be reputation consequences. Harvey is likely going to try to stay out of trouble.
