Halt: Aretha Franklin’s son wants to stop estate rep from spending

Stop using her money! Aretha Franklin’s son, Kecalf Franklin, claims the personal representative who handles her estate is on a spending spree. He wants the judge to put a stop to it by handing her a temporary restraining order.

According to TMZ, and other news outlets, Franklin’s son wants the judge to issue a temporary restraining order against Sabrina Ownes, the estate personal representative. The restraining order would bar her from making any decisions on behalf of the estate until the court decides whether she has the legal right to do so. Kecalf alleges Ownes has sold properties, other personal items, and she transferred a car to her name. Allegedly, it was believed Aretha died without a will in 2018, however as of recently three different wills were found in her home, the family wants the court to figure out which one is valid.

Generally, when there is no will left behind by the deceased we identify the legal heirs and each share is entitled to inherit. Since there have been three different wills found, the court will look at which will is the newest, if they are original copies or not, the court will also look to see if the will-maker had the intent of destroying an older will. The will that is the newest will generally end up being valid, assuming there are no other issues with its validity.
