Pop icon Britney Spears and Sam Asghari are engaged after nearly five years of dating.
This engagement was a point of issue the artist had with her conservatorship amongst other things such as being forced to stay on birth control to prevent new pregnancies. Some celebrities have come to respond to this announcement with the advising of signing a prenup. A prenuptial agreement is a legal contract describing what will occur with a newlywed couple’s assets and debts should they divorce. where two parties sign before they enter into the institution of marriage. To have a valid prenup in California, a couple must draw up the contract per specific laws and regulations such as California’s Uniform Premarital Agreement Act (UPAA). Some of these requirements include voluntary signatures, a notary signature, and lawful terms within the prenup. A prenup can help protect any property, cash, or other assets that were obtained prior to marriage.
Unfortunately, Spears’ conservatorship may still prove to be a continued barrier in her marriage. It appears seemingly over now that her father has filed a petition seeking to terminate it, but it’s still not a given. The probate court’s primary concern is what is best for her in this situation as the end of the conservatorship without a clear plan in place would be good for her either, as there is no formal mechanism in place to ensure a conservatee has protections following termination. The order implies the person has the wherewithal to manage her own life. However, her lawyers have suggested a private professional fiduciary of Spears’ choosing could advise her on how to protect her assets, and a similar professional support system could be set up with her involvement to ensure she’s getting proper physical and mental health care. It’s unlikely that Judge Penny will issue a ruling on Jamie’s petition to end the conservatorship at the next hearing on Sept. 29.
