DRESS FOR DRAMA: Khloe Kardashian Accused of Selling a Dress Designer Christian Cowan Loaned Her

Something Borrowed. Something Blue.

Khloe Kardashian may be in some trouble with a fashion industry major. It was recently reported that designer Christian Cowan is upset with the reality star for attempting to sell a sample dress she was only supposed to borrow.

Khloe listed the dress on Kardashian Kloset, the Kardashians’  resale website for a price of $1,300. There seems to be a discrepancy between the two camps as to who is now that rightful owner of the dress. According to Page Six an insider stated that “The dress was gifted to her through her stylist without mention of a loan and it was never asked to be returned.” According to Cowan, he has reached out to Khloe’s team at least 3 times and received no response.

In order for a gift to be legally proper, there must be delivery, donative intent and acceptance. Intent to make a gift is essentially determined by the donor’s words, but the courts also considers the surrounding circumstances, the relationship of the parties, the size of the gift in relation to the amount of the donor’s property as a whole, and the behavior of the donor toward the property subsequent to the purported gift. More than likely, there was no donative intent here being that the rightful donor is quite upset regarding the non-return of the dress. Khloe seemingly thinks so as well, being that the dress was removed from the website following the accusations.
